1. Services Provided

We offer a range of home services including, but not limited to, Real Estate Photography, Listing Rental Property, Smoke Alarm and related Services [Carbon Monoxide Detectors Fire Extinguishers], Cleaning Services, and Security Camera Service. Our services are detailed in many ways including, but limited to website, social media accounts, direct contact by using our contact from, or provided upon request.

2. Service Agreement

Scope of Work: The scope of work for each service will be outlined in a service agreement or estimate provided before the commencement of work.

Changes: Any changes to the agreed-upon scope of work must be documented and approved by both parties.

3. Scheduling and Appointments

Booking: Services can be scheduled through our website contact form, email or by phone.

Cancellation and Rescheduling: To cancel or reschedule an appointment, please provide at least 24 hours' notice. Late cancellations or no-shows will result in a cancellation fee *please read payment terms:4.

4. Payment Terms

Pricing: Service fees will be detailed in a written estimate. Any additional costs incurred due to unforeseen issues will be communicated and agreed upon before proceeding.

Payment: Payment is due before starting the service unless otherwise arranged. We accept [Cash, credit/debit cards, or by money transfer apps (must be approved by both parties)].

Late Payments: A late fee may be applied to overdue invoices. Failure to settle accounts may result in suspension of services.

Cancellation: Canceling at the time of the appointment or while our team member is heading to the location will result in a charge of half the total service fee.

5. Service Guarantee

We guarantee that our work will be performed to the highest standards. Should you experience any issues with the service provided, please contact us within [3 days] for a resolution. We will address and rectify any issues at no additional cost if they fall within the scope of the original service.

6. Client Responsibilities

Access: Ensure that our team has unobstructed access to the areas where services are to be performed.

Information: Provide accurate and complete information regarding the project to avoid delays or additional costs.

Permissions: Obtain any necessary permits or approvals required for the work to be performed

7. Limitation of Liability

Service Quality: Houze 4 u pro fessional Home Services LLC is not liable for any indirect, incidental, or consequential damages arising from the provision of services.

Service Delays: Our liability is limited to the rescheduling of services or a partial refund in the event of delays [more than 1 hour from the appointment time] or cancellations caused by our team.

Product Warranty: Our liability is limited to the manufacturer's warranty on any products we supply and install minus 3 days of the total days of the warranty [if manufacturer's warranty was 30 days, our liability is limited to 27 days]. We do not assume liability for defects or failures beyond this coverage.

Personal Injury: Our liability is limited to the scope of our services as defined in the agreement. We are not liable for any personal injury that occurs outside the service area, before our arrival, or after our departure. We are not liable for any personal injury caused by third parties, environmental conditions, or unforeseen circumstances. We are not responsible for any personal injury resulting from the client's misuse of equipment, failure to maintain a safe environment, or actions taken independently of our advice.

8. Intellectual Property

All content on our website and any proprietary information provided is the intellectual property of Houze 4 u pro fessional Home Services LLC. Unauthorized use or reproduction is prohibited.

9. Privacy Policy

We value your privacy. Our Privacy Policy, available on our website, outlines how we collect, use, and safeguard your personal information.

10. Termination of Services

We reserve the right to terminate or suspend services if you breach these terms, fail to make payment, or if we determine that the service cannot be reasonably performed.

11. Dispute Resolution

Specific Terms of Service for Smoke Alarm & Related Services

Effective Date: 9/10/2024

1. Scope of Services

We provide installation, maintenance, and testing of smoke alarms, carbon monoxide detectors, and fire extinguishers. Our services include:

Installation of smoke alarms and related devices.
Routine maintenance and testing of installed equipment.
Replacement of parts or devices as necessary.

Additional services or repairs beyond the scope listed above will be provided upon request and may incur additional charges.

2. Liability Disclaimer

While we strive to provide high-quality services, we do not guarantee the effectiveness of smoke alarms, carbon monoxide detectors, or fire extinguishers in preventing property damage or personal injury. Our liability is limited to the cost of the services rendered. We are not responsible for any indirect, incidental, or consequential damages resulting from equipment failure or service issues.

3. Customer Responsibilities

Customers are required to:

Provide clear access to installation areas and ensure the site is prepared for service.
Inform us of any pre-existing issues or special conditions that may affect the service.
Maintain the installed equipment according to manufacturer guidelines.

4. Payment Terms

Payment is due upon completion of the services unless otherwise specified in a written agreement.
A late fee of [X%] per month will be applied to overdue invoices.
Any additional services or parts required beyond the initial scope will be billed separately.

5. Warranty and Return Policy

For certain packages, all installed parts come with 30 months of warranty against defects in material or workmanship. This warranty covers only the replacement of defective parts and does not include labor or additional services. For any additional or different packages requested by the client or offered by us, a customized policy will be sent to client by email or will be provided at the time of order placement.
Follow-Up Testing Schedule: To maintain the validity of the parts warranty, clients are required to schedule a follow-up testing service within 8 months of the installation date. Second testing schedule after 12 months of the first testing schedule is mandatory. This testing ensures that all equipment is functioning correctly and meets safety standards.
If the client fails to schedule and complete the two testing services within this period as mentioned above, the warranty on the parts will be voided.

Warranty claims must be made within the warranty period and will be addressed by part replacement at our discretion.
Any additional services or parts required beyond the initial scope will be billed separately.

9. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Any changes will be effective upon posting on our website or providing notice to the customer.

Specific Terms of Service for Real Estate Photography

Effective Date: 9/10/2024

Service Scope

The photographer will provide professional photography services, including but not limited to interior, exterior, and aerial (if applicable) property shots, as per the package selected by the client.
Any additional requests outside the agreed package may incur extra charges.

Usage Rights

The client is granted a limited, non-exclusive license to use the photos for the purpose of marketing, renting, and selling the property.
Photos may not be used for any other purposes (e.g., commercial, print) without the photographer's prior written consent.
Photographer retains full copyright ownership of all photos unless otherwise agreed in writing.

Photo Delivery and Revisions

Photos will be delivered within 7 business days after the shoot.
Any requests for retouching or additional edits must be made within 2 days of delivery, and such services may incur additional fees.
Photos are delivered digitally via [email/download link] in [JPEG, PNG, etc.] format unless otherwise requested.

Rescheduling and Cancellation

The client must provide at least 24 - 48 hours of notice to reschedule or cancel a scheduled shoot.
Cancellations made with less than 24 hours' notice will result in a cancellation fee of [$40].
Rescheduling is subject to availability and may incur a rescheduling fee.

Payment Terms

A non-refundable deposit of [$40] is required to secure the booking, with the remaining balance due upon delivery of the final photos.
Invoices must be paid on the delivery date. Late payments will incur interest at a rate of [5]% per day.

Weather Policy

Outdoor photography is subject to weather conditions. In the event of inclement weather, the shoot may be rescheduled at no extra cost.
If the client insists on proceeding with the shoot despite poor weather conditions, the photographer is not liable for any diminished photo quality as a result.

Liability

The photographer will exercise all reasonable skill and care in the performance of the services. However, the photographer is not responsible for any missed shots, poor lighting, or unexpected issues with the propertyÂ’s condition.
The client is responsible for ensuring the property is prepared and staged appropriately before the scheduled shoot or our company will offer cleaning and organizing services for extra cost prior to photo session.

Model and Property Releases

The client is responsible for obtaining any necessary permissions or releases for individuals or private properties that appear in the photos.
The photographer is not liable for any claims regarding unauthorized individuals or locations appearing in the images.

Archival of Photos

Photos will be archived for a period of 6 months. After this period, the photographer is not responsible for maintaining backups of the images.
Re-delivery of archived images may incur an additional fee.

Indemnification

The client agrees to indemnify and hold harmless the photographer from any claims, damages, or expenses arising from the client's use of the photos, including third-party claims regarding unauthorized use or copyright infringement.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Any changes will be effective upon posting on our website or providing notice to the customer.

Specific Terms of Service for Listing Rental Property Services

Service Scope

Houze4u Pro Home Services LLC provides an online platform for property owners, which may include individual landlords, apartment offices, or management companies, to list rental properties. The service includes hosting property details, images, and contact information for prospective tenants to view and inquire about.
We do not guarantee the rental or lease of any listed property and are not responsible for negotiating or executing rental agreements between the property owner and the tenant.

Accuracy of Listings

The property owner is responsible for ensuring the accuracy and completeness of all information submitted, including but not limited to property descriptions, pricing, availability, and contact details.
Houze4u Pro Home Services LLC is not liable for any errors, omissions, or inaccuracies in property listings.
Property listings may be removed or edited at the companyÂ’s discretion if they are found to contain inaccurate or misleading information.

Property Owner Responsibilities

Listing property owners are responsible for ensuring that their properties comply with all applicable local, state, and federal laws, including tenant rights, safety regulations, and rental laws.
Owners must ensure that the property is in good condition, safe, and habitable before listing it on the platform.
The property owner agrees to indemnify and hold Houze4u Pro Home Services LLC harmless from any claims arising out of the rental, use, or occupancy of the listed property.

Listing Fees and Payments

Listing fees, if applicable, must be paid in advance according to the selected package. Fees are non-refundable once the property is live on the website, except in cases of technical issues attributable to the platform.
Any additional services such as promotional listings or featured properties will incur additional charges, which will be detailed before being applied.

Property Removal and Suspension

Houze4u Pro Home Services LLC reserves the right to remove or suspend any property listing that violates our terms of service or applicable laws, including properties that are deemed unsafe or non-compliant with local regulations.
Listings may be temporarily suspended due to maintenance or policy violations, and Houze4u Pro Home Services LLC will notify the property owner in such cases.

Communication with Tenants

Our platform provides direct messaging only from tenants to listing property owners for inquiries related to property listings. Houze4u Pro Home Services LLC is not responsible for any agreements, disputes, or communications between tenants and listing property owners as Houze4u Pro Home Services LLC is not a management company.
Listing property owners are expected to respond to tenant inquiries promptly and professionally.

Dispute Resolution

Any disputes arising between listing property owners and tenants regarding the listed property, lease terms, or rental payments are solely the responsibility of the involved parties. Houze4u Pro Home Services LLC is not liable for resolving such disputes.
Listing property owners must ensure they comply with all local tenant laws and agree to indemnify Houze4u Pro Home Services LLC from any legal claims made by tenants.

Limitation of Liability

Houze4u Pro Home Services LLC is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform, the inaccuracy of listings, or disputes between listing property owners and tenants.
Our platform serves as a facilitator and does not guarantee the availability, reliability, or suitability of the listed properties.

Termination of Service

Houze4u Pro Home Services LLC reserves the right to terminate a listing or the account of any property owner for violating the terms of service or for engaging in unethical or illegal practices.
Termination of a listing due to violations will not result in a refund of any fees paid.

Data Privacy

Listing property owners consent to the collection and storage of personal data such as contact information for the purpose of listing and managing properties. All data is stored securely and in compliance with relevant privacy laws.
The platform will not share personal data with third parties without consent unless required by law.

Indemnification

The property owner agrees to indemnify, defend, and hold Houze4u Pro Home Services LLC, its affiliates, and its employees harmless from any claims, damages, liabilities, or expenses arising out of or related to the rental listing or use of the platform.

Specific Terms of Service for Cleaning Services

Effective Date: 9/10/2024

Service Scope

Houze4u Pro Home Services LLC provides residential and commercial cleaning services, including rental property preparation for new tenant and cleaning, general cleaning, deep cleaning, move-in/move-out cleaning, and specialty cleaning as per the selected service package.
Subcontracting: Houze4u Pro Home Services LLC reserves the right to subcontract third-party cleaning businesses to fulfill some of the cleaning services. Subcontractors will adhere to the same standards and policies as our in-house team. We will ensure that all subcontractors are qualified and adhere to our service quality requirements.

Client Responsibilities

The client must ensure the property is accessible at the agreed-upon time for cleaning services. If the property is inaccessible, resulting in delays or inability to perform services, the client may be charged for the missed appointment.
The client is responsible for securing or removing valuable items. Houze4u Pro Home Services LLC and its subcontractors are not liable for damage or loss of valuables left unsecured.

Health and Safety

The client agrees to disclose any potential health or safety hazards (e.g., hazardous materials, pest infestations) within the property prior to the cleaning service.
Houze4u Pro Home Services LLC reserves the right to decline or terminate services if the working environment is deemed unsafe for its employees or subcontractors.

Cleaning Standards and Rework

Cleaning services are provided according to industry standards. If the client is not satisfied with the service, they must notify Houze4u Pro Home Services LLC within 24 hours to request a rework. Rework will only be performed if the dissatisfaction is due to incomplete or unsatisfactory cleaning that falls within the agreed-upon scope.
Rework does not include additional services beyond the original service agreement.

Payment Terms

Full payment is due on the order day unless otherwise agreed in writing. For recurring services, payments must be made before the cleaning service.
A deposit of 50% of full payment will be acceptable, and the remaining balance will be due upon service completion.
Failure to pay within the specified terms may result in late fees and suspension of future services.

Cancellation and Rescheduling

The client must provide at least [24] hoursÂ’ notice for cancellation o rescheduling of services. Cancellations made with less than [24] hours' notice will incur a cancellation fee of [$40].
Rescheduling is subject to availability and may incur a rescheduling fee.

Limitations of Liability

Houze4u Pro Home Services LLC and its subcontractors are not liable for any direct, indirect, incidental, or consequential damages arising from the use of the services, the inaccuracy of service delivery, or disputes between the client and any subcontractors.
The company is not responsible for any pre-existing conditions of the property, including but not limited to broken fixtures, loose tiles, or improperly installed items. Any such damage must be reported immediately upon discovery.

Insurance and Damage

Houze4u Pro Home Services LLC is insured for general liability. In the event of accidental damage to the property, claims must be reported within 24 hours of service completion.
Our liability for damage is limited to the actual damages and does not include any indirect or consequential damages.

No Guarantee for Specific Results

Houze4u Pro Home Services LLC does not guarantee the removal of all stains, odors, or deep-set grime. Some cleaning issues may require specialized equipment or services beyond the scope of standard cleaning packages.
We will make every effort to provide thorough cleaning services but are not responsible for circumstances where cleaning results are limited due to the condition of the property or prior treatment.

Termination of Services

Either party may terminate recurring cleaning services with [2] days' written notice. Houze4u Pro Home Services LLC reserves the right to terminate services if the client violates the terms of service, engages in unsafe practices, or fails to make timely payments.

Indemnification

The client agrees to indemnify and hold Houze4u Pro Home Services LLC and its subcontractors harmless from any claims, damages, or liabilities arising from the clientÂ’s failure to disclose hazards or unsafe conditions, o from the clientÂ’s failure to properly secure valuable items.

Specific Terms of Service for Security Home Services

Effective Date: 9/10/2024

Service Scope

Houze4u Pro Home Services LLC provides home security services, including the installation and maintenance of security systems such as alarms, cameras, and other safety equipment.
Services include initial system assessment, equipment installation, and basic training on system operation. Any additional services or upgrades requested by the client will be provided at an additional cost.

Client Responsibilities

The client is responsible for ensuring that the installation site is accessible on the agreed-upon date and time. If access is denied or delayed due to the clientÂ’s actions, additional charges may apply.
The client must inform Houze4u Pro Home Services LLC of any pre-existing conditions that might affect the installation, such as structural issues or existing electrical problems.

Equipment and Installation

All equipment provided and installed by Houze4u Pro Home Services LLC remains the property of the company until payment is received in full.
Installation will be performed according to industry standards. If the client requests changes or modifications not included in the initial agreement, additional charges may apply.
The client is responsible for ensuring that the property is ready for installation, including any necessary permits or approvals.

System Performance and Monitoring

Houze4u Pro Home Services LLC does not guarantee the performance of third-party equipment or systems. The company will provide basic functionality checks and operational training but is not responsible for any failures or defects in third-party products.
Monitoring services, if included, are subject to the terms and conditions of the monitoring provider, which may be separate from Houze4u Pro Home Services LLCÂ’s agreement.

Maintenance and Repairs

Regular maintenance is not included unless specified in the service agreement. Clients are responsible for scheduling maintenance and repairs as needed.
Any repairs required due to client negligence or misuse will be charged at an additional rate.

Payment Terms

Full payment for services is due on the order day unless otherwise agreed.
Failure to pay according to the agreed terms may result in service suspension and late fees.

Cancellation and Rescheduling

Clients must provide at least [48] hoursÂ’ notice for cancellation or reschedu ling of services. Cancellations made with less than [48] hours' notice may incur a cancellation fee of [$40].
Rescheduling is subject to availability and may incur a rescheduling fee.

Limitations of Liability

Houze4u Pro Home Services LLC is not liable for any damages resulting from equipment failure, including but not limited to security breaches, false alarms, or system downtime.
The company is not responsible for any property damage occurring during the installation process that arises from pre-existing conditions or client actions.
Our liability is limited to the cost of the services provided and does not include any indirect or consequential damages.

Warranty

All installed equipment is covered by a [25]-days warranty against defects in materials and workmanship. Warranty does not cover damage caused by misuse, neglect, or unauthorized modifications.

Termination of Services

Either party may terminate services with [2] days' written notice. Houze4u Pro Home Services LLC reserves the right to terminate services if the client fails to adhere to the terms of service, engages in unsafe practices, or fails to make timely payments.

Indemnification

The client agrees to indemnify and hold Houze4u Pro Home Services LLC harmless from any claims, damages, or liabilities arising from the clientÂ’s failure to disclose hazards or unsafe conditions, or from an issues related to the operation of the security system.

Confidentiality and Data Protection

Houze4u Pro Home Services LLC will not access, store, or manage data collected by third-party security equipment. The company will only use data as necessary to perform installation, testing, and maintenance services.
The client is responsible for ensuring that all data handling and privacy policies related to the third-party equipment comply with applicable data protection laws. Houze4u Pro Home Services LLC will not be held liable for data breaches or privacy issues related to third-party equipment.
